Terms of Service
General Terms
I, Lumisha, reserve the right to update these terms of service at any time.

By obtaining a Bottle Nymph, you agree to the terms below. A user who fails to follow the ToS will result in their account(s) being banned and submitted to a black list*.
Bottle Nymphs are a ‘closed’ adoptable species owned by Lumisha (Luminosity-Shade). When purchasing a Bottle Nymph design or MYO (make your own) ticket, you are purchasing partial rights to the design. You do not hold ownership over the Bottle Nymph species, and as such, you do not hold full rights to any Bottle Nymph design you own. Any concept or design made outside of Bottle Nymphs is not official without written permission from Lumisha.
*The black list is a public document containing information such as the offender’s account username as well as their reason for list placement.

Copyright
I, Lumisha (Luminosity-Shade), retain the copyright of Bottle Nymph designs created by myself or other guest artists, as well as any content or written lore involving Bottle Nymphs. As such, I have the right to use official art/designs for any website or platform to promote Bottle Nymphs, including merchandise. I, however, do not claim copyright over user submitted content.
Distributing, modifying, copying, publishing or uploading any established content involving Bottle Nymphs is strictly prohibited unless otherwise permitted. Scraping established content for AI image generation is also strictly prohibited.

MYO (Make Your Own)
A Bottle Nymph MYO is a design that is converted into an official Bottle Nymph design, designed by users or other artists. They do not include designs made by guest artists or custom designs by Lumisha (Luminosity-Shade).
A user retains the copyright to their MYO design, but not the copyright of Bottle Nymphs.
MYOs may be redesigned for free if the design’s traits remain the same, along with Lumisha’s (Luminosity-Shade) written permission.
A MYO can be withdrawn for free from the Bottle Nymph species at any time, converted into other species, or even used commercially as long as the Bottle Nymph traits are removed and the user has written approval from the original design’s artist and Lumisha (Luminosity-Shade). Your MYO will be removed from the Bottle Nymph masterlist.
MYOs or MYO tickets cannot be resold, but can be gifted or traded. Reselling or selling a MYO will result in the design becoming void and being withdrawn from the official masterlist. If a user decides to sell/resell a MYO design, they must ensure all Bottle Nymph specific traits are removed. There are no refunds for MYO tickets.
A MYO ticket has no expiration date, but will not become valid until it is used. A finished design or concept must be given in order to make the MYO official for it to be added to the masterlist.

When a user deletes their account, their MYO becomes void and will be removed from the masterlist.
Bottle Nymph Designs (Adopts)
A Bottle Nymph design or adoptable is a design made by a guest artist or by Lumisha (Luminosity-Shade). They can be given alternate outfits but their traits cannot be changed.
Personal use of Bottle Nymph designs is permitted. Personal use includes but is not limited to: displaying the character/artwork or any artwork depicting the design (must include proper credit to the artist), use the character for Bottle Nymph events as well as giving the character a name and backstory, and creating or commissioning art/ writing for them.
Commercial use of Bottle Nymph designs is prohibited without Lumisha’s (Luminosity-Shade) explicit written permission. Commercial use includes any activity with the intention of financial gain, such as merchandise depicting the design or derivatives of the design.
Bottle Nymph designs that are designed by guest artists or by Lumisha (Luminosity-Shade) cannot be converted into another species.
Bottle Nymph designs may be resold by the buyer for the exact price or value that the design has.

When a user deletes their account, their official design will be either resold or re-raffled depending on how it was sold.
Banned Users
When a user is banned, their name will be publicly stated on the Bottle Nymph’s black list and all ownership of their designs created by Lumisha (Luminosity-Shade) or by guest artists will be revoked.
Bottle Nymph designs made by Lumisha (Luminosity-Shade) or by guest artists will be put back up for sale.
MYO designs will be removed from the official masterlist and will no longer be considered a Bottle Nymph design.

Payment/Purchases or Sales
Bottle Nymph designs may not be gifted, sold or traded to users under 18.
All sales are through PayPal Invoice with USD, unless otherwise stated. Invoices will be sent by either Lumisha (Luminosity-Shade), staff or guest artists.
Upon placing a bid on an auction or a claim on a Bottle Nymph design, a user is not permitted to back out or delete a bid, as well as lowering their bid price. When placing a bid or claim, you are confirming you can and will pay, and backing out will result in either discipline or ban. I reserve the right to refuse a sale for any reason.
For designs that are set priced/raffled: If a user is unavailable at the time of a sale, they may elect a single user to claim a design for the aforementioned user’s behalf. This must be stated in the claim comment. However, placing a claim for both yourself and for someone else is prohibited as it is unfair to other users. Editing the comment will revoke the claim.
Co-Ownership is allowed as long as both users follow the terms of service.
Once a user has won a Bottle Nymph design, they are required to pay in full within 48 hours unless otherwise stated. Full payment must be received before the design can be transferred to the winning user. Failure to respond will result in the design being sold to another user. Failure to pay will result in the user being banned.
All transactions for Bottle Nymph designs are final and are non refundable. Filing a chargeback or scamming Bottle Nymph staff will result in the user being listed in the black list and have a complaint filed against them.
Payment Plans
Payment plans are only offered for Bottle Nymph designs that allow payment plans and that are on auction with bids exceeding over $100.
Payment plan length can vary depending on the artist. Buyers are required to pay a 25% deposit upfront, and failure to pay the full amount at the end of the payment plan will result in no money being refunded.
