General Terms
We reserve the right to update these terms of service at any time.
By obtaining a Bottle Nymph, you agree to the terms below. A user who fails to follow the terms of service will result in their account(s) being banned.
Bottle Nymphs are copyright by Lumisha (Luminosity-Shade). When purchasing a Bottle Nymph design or MYO (make your own) ticket, you are purchasing partial rights to the design. Ownership of a Bottle Nymph character does not equal ownership of the Bottle Nymphs brand or IP, your rights to the design are limited to personal use only. Any concept or design made outside of Bottle Nymphs is not official without written permission from Lumisha.
Make Your Own (MYO)
What is a MYO? A Bottle Nymph MYO is a design made by a user that does not include official designs made by our Bottlemakers or by Lumisha. A user can only make a MYO if they have a ‘Basic Glass Bottle’ in their inventory.
A user retains the copyright to their MYO design, but not the copyright of Bottle Nymphs.
MYOs may be redesigned for free if the design’s traits remain the same, along with Lumisha’s (Luminosity-Shade) written permission.
A MYO can be withdrawn for free from the Bottle Nymph site at any time, converted into other species, or even used commercially as long as the Bottle Nymph traits are removed and the user has written approval from the original design’s artist and Lumisha (Luminosity-Shade). Afterwards, your MYO will be removed from the Bottle Nymph masterlist.
MYO designs may be sold, gifted, or traded by the user. If a MYO is for sale, their price should be equal to their art value or for the price of a Basic Glass Bottle.
A MYO Basic Glass Bottle item has no expiration date, but will not become valid until it is used. A finished design or concept must be given in order to make the MYO official for it to be added to the masterlist.There are no refunds upon purchasing this item and the item is strictly account bound.
Official Bottle Nymph Designs
What is considered official? An official Bottle Nymph design is made either by Lumisha or our Bottlemakers and are only sold in the Designs market page. Their overall design and core traits cannot be removed/ changed, but a user may add traits and make minor edits to the original design (color changes, etc.). A user may add alternate outfits.
Only personal use is permitted for official Bottle Nymphs designs. Personal use includes but is not limited to: displaying the character/artwork or any artwork depicting the design (must include proper credit to the artist), use the character for Bottle Nymph events as well as giving the character a name and backstory, and creating or commissioning art/ writing for them.
Commercial use of official Bottle Nymph designs is prohibited without Lumisha’s (Luminosity-Shade) explicit written permission. Commercial use includes any activity with the intention of financial gain, such as merchandise depicting the design or derivatives of the design.
Official Bottle Nymph designs that are designed by Bottlemakers or by Lumisha (Luminosity-Shade) cannot be converted into another species.
Official Bottle Nymph designs may be resold by the buyer for the exact price or value that the design has.
Purchases and Sales
All sales and transfers of Bottle Nymph designs are only permitted to occur on the website bottlenymphs.com. Bottle Nymph designs may not be gifted, sold or traded to users under 18, or users without accounts on the Bottle Nymph site.
Bottle Nymphs reserves the right to refuse a sale for any reason. If a user places a bid in an auction, a claim on an official Bottle Nymph design, or an entry to a raffle, they are not permitted to back out, delete a bid, or lower their bid price. Upon placing a bid or claim, you are confirming you can and will pay. Backing out will result in either discipline or ban.
For designs that are set priced or raffled: If a user is unavailable at the time of a sale, they may choose one single user to claim a design on the aforementioned user’s behalf. This action must be stated upon claiming, however, placing a claim for both yourself and for someone else is prohibited as it is unfair to other users. Editing the comment will revoke the claim.
Co-Ownership is allowed as long as both users follow the terms of service.
Payments and Payment Plans
All sales are through PayPal Invoice with USD, unless otherwise stated. Invoices will be sent by the Bottlemaker that designed your purchase.
All transactions for official Bottle Nymph designs are final and are non refundable. Filing a chargeback or scamming Bottle Nymph staff will result in the user having their account banned.
Once a user has won an official Bottle Nymph design, they are required to pay in full within 48 hours upon receiving the invoice unless otherwise stated. Full payment must be received before the design can be transferred to the winning user. Failure to respond or pay will result in the design being sold to another user. Failure to pay will result in the user being banned.
Payment plans may be offered for select Bottle Nymph designs when specified in their listing.
Payment plan length can vary depending on the artist. Buyers are required to pay a 25% non-refundable deposit upfront, and failure to pay the full amount at the end of the payment plan will result in your account being banned.
Banned Users and Accounts
When a user is banned, all ownership of their designs created by Lumisha or by Bottlemakers will be revoked.
Revoked official Bottle Nymph designs created by Lumisha or by Bottlemakers will be retired from being repurchased and instead be made into NPCs (non-playable characters) in the game.
MYO designs will be removed from the official masterlist and will no longer be considered a Bottle Nymph design.
